Bartynder is an on-demand staffing marketplace for the hospitality industry, operated by Disgo, Inc., a Delaware corporation ("Disgo," "we," "us," or "our"). Bartynder is a branded service licensed and operated by Disgo, Inc. This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you use the Bartynder platform, mobile application, website, or any related services (collectively, the "Services").
By accessing or using the Services, you agree to the terms of this Privacy Policy. If you do not agree, please do not use the Services.
1. About Bartynder and Disgo, Inc.
Bartynder is a service of Disgo, Inc. In some markets, Disgo licenses the Bartynder platform to venue operators ("Licensed Operators") under a licensing and operating agreement. When you interact with Bartynder through a Licensed Operator's venue, Disgo, Inc. remains the data controller responsible for the personal information collected through the Bartynder platform. Licensed Operators may have access to certain operational data as outlined in Section 5 of this policy.
All data practices described in this Privacy Policy apply to the Bartynder platform regardless of whether you access it directly or through a Licensed Operator.
2. Information We Collect
2.1 Information You Provide
• Name, email address, and mobile phone number
• Profile information (professional experience, certifications, availability)
• Payment information (processed securely through third-party payment processors)
• Identity verification documents, where required by law
• Communications you send us through the platform or support channels
2.2 Information Collected Automatically
• Device information (device type, operating system, unique device identifiers)
• Usage data (pages visited, features used, time spent, clicks)
• Location data, if you grant permission through your device settings
• Log data (IP address, browser type, referring/exit pages, timestamps)
• Cookies and similar tracking technologies
2.3 Information from Third Parties
We may receive information about you from venue operators, background check providers (where applicable), and analytics or advertising partners.
3. How We Use Your Information
We use the information we collect to:
• Create and manage your account
• Match staffing professionals with venue operator opportunities
• Process payments and payouts
• Send transactional and operational communications, including SMS messages
• Provide customer support
• Improve and develop the platform
• Comply with legal obligations
• Detect, prevent, and address fraud, abuse, or security issues
• Send marketing communications where you have provided consent
4. SMS and Mobile Communications
Bartynder uses SMS text messaging to deliver important operational notifications, including shift confirmations, booking alerts, schedule updates, and support communications.
4.1 Consent to Receive SMS
By providing your mobile phone number and creating an account or opting in to SMS communications, you consent to receive text messages from Bartynder at the number you provide. Standard messaging terms apply as described below.
4.2 Message Frequency
Message frequency varies based on your activity on the platform and the nature of your role. You may receive operational messages when shifts are confirmed, modified, or cancelled; when new opportunities matching your profile are posted; and when time-sensitive updates require your attention. Marketing or promotional messages will only be sent where separately consented to.
4.3 Message and Data Rates
Message and data rates may apply. Your mobile carrier may charge fees for text messages and data usage. Disgo, Inc. is not responsible for any charges imposed by your mobile carrier.
4.4 Non-Sharing of Mobile Numbers
We do not sell, rent, share, or disclose your mobile phone number to third parties for their own marketing or promotional purposes. Your mobile number may be shared with service providers who assist us in delivering SMS communications on our behalf (such as messaging platform providers), and such providers are contractually prohibited from using your number for any purpose other than delivering Bartynder messages.
4.5 Opting Out
To stop receiving SMS messages from Bartynder, reply STOP to any message at any time. You may also contact us at info@disgoapp.io. After opting out, you may still receive non-marketing transactional messages necessary for safety, security, or account management unless required by law to cease all messages.
5. How We Share Your Information
We do not sell your personal information. We may share your information in the following circumstances:
5.1 With Licensed Operators
If you are a staffing professional, venue operators to whom you are matched may receive limited profile information (such as your name, relevant credentials, and ratings) necessary to fulfill the staffing engagement. Operators do not receive your mobile phone number or payment information.
5.2 With Service Providers
We share information with trusted third-party vendors who perform services on our behalf, including payment processing, SMS delivery, identity verification, analytics, and cloud infrastructure. These providers are bound by contractual obligations to protect your information and use it only for the services they provide to us.
5.3 For Legal Compliance
We may disclose your information if required to do so by law, regulation, court order, or government request, or where disclosure is necessary to protect the rights, property, or safety of Disgo, Bartynder users, or the public.
5.4 Business Transfers
In connection with a merger, acquisition, sale of assets, or reorganization of Disgo, Inc., your information may be transferred to the successor entity, subject to the commitments of this Privacy Policy.
5.5 With Your Consent
We may share your information for any other purpose with your explicit consent.
6. Data Retention
We retain your personal information for as long as your account is active or as needed to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. When information is no longer needed, we delete or anonymize it in accordance with our data retention practices.
7. Security
We implement technical, administrative, and physical safeguards designed to protect your information against unauthorized access, disclosure, alteration, or destruction. However, no security system is impenetrable, and we cannot guarantee the absolute security of your information. You are responsible for maintaining the confidentiality of your account credentials.

Depending on your jurisdiction, you may have certain rights with respect to your personal information, including:

9. Children's Privacy
The Bartynder platform is not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. 10. California Privacy Rights
If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), including the right to know what personal information is collected and how it is used, the right to opt out of the sale or sharing of personal information (we do not sell personal information), the right to non-discrimination for exercising your privacy rights, and the right to limit the use of sensitive personal information.

We may update this Privacy Policy from time to time. When we make material changes, we will notify you by updating the effective date at the top of this policy and, where appropriate, by sending an in-app notification or email.
